General conditions of sale – accademia italiana web site

The General Conditions of Sale (hereinafter, the “General Conditions”) regulate sale to end consumers (hereinafter known as “Clients”) of the clothing items and relevant accessories in the ACCADEMIA ITALIANA collection (hereinafter known as “Products”) sold by Il Progetto S.r.l. owner of ACCADEMIA ITALIANA BRAND with sole proprietorship (hereinafter known as “Il Progetto”), through the dedicated area of the web site following the procedures stated in the web site, between Il Progetto and the Clients.
Products will be marketed through the website (hereinafter known as “Website”), exclusively in the countries listed in the menu of access to the on LINE SHOP. To be able to access to the market area of website you must complete the registration process with Username and Password.
For the purpose of these General Conditions, the end consumer is any physical person acting for purposes not including business, trade, artisanal or professional activities carried out.
Products are sold by Il Progetto S.r.l. with sole proprietorship with headquarters in Piazza Italia,11 – 23807 Merate (LC) (ITALY), P.IVA/C.F. 02930270133 R.E.A. 1948473. For all information concerning these General Conditions and/or purchases made on the basis of same, the persons concerned can send a email to


3.1.The sales price for the Products, shipping costs and payment methods are those listed on the Web site and are expressed in Euro. The retail prices of the Products include VAT but do not include shipping costs, which will be added to the total amount owed.
Il Progetto reserves the right to change the prices listed on the Web site at any moment; in any case, the price changes will not be applied to products already ordered by the Client. Under no circumstances can Il Progetto be held responsible for any changes in price.

3.2 The Client undertakes to pay the price for Products purchased according to the following methods:
– PayPal. Credit card payments will be managed by safe servers which, thanks to the use of protocols using SSL 128 bit cryptography, can guarantee the security of on line transactions. Therefore, Il Progetto will not be aware of the Client’s credit card information.

4.1. Products will be shipped based on the timeframe. Shipping costs will be charged to the Client and can vary based according to the delivery service chosen.
Once goods have been shipped, Il Progetto will send the Client an email informing of shipping plus information to track the items.
In the event of delays to shipping due to causes that do not depend on the wishes of Il Progetto, the Client will be informed of this in good time, by Il Progetto customer service.
Products will only be shipped exclusively in the countries listed in the menu of access to the ON LINE SHOP.

4.2. Risks concerning Products pass to the Client at the time that said Products are consigned to the courier.

5.1. The Client has the right to withdraw from the contract, without penalties or specifying the reason for same, within 14 days, from the date of receipt of Products purchased on the basis of the General Conditions.

5.2. It is an essential condition for withdrawal from the contract by the Client that the Products to be returned are integral and undamaged. Specifically, the Products shall not have been used, worn, washed or damaged; the identification label shall still be attached to the Products. This also applies to the various composition and care labels.

5.3. This withdrawal may be exercised, within the term as per article 5.1., by returning the purchased Products, To start the process of returning the goods the customer must write an email to specifying that it intends to withdraw from the purchase. Il Progetto will confirm the start of the procedure by sending a email to the Client with attached the “Return Form” containing confirm and instructions.

5.4. The Client shall return the Products via a courier of choice or via the courier indicated by Il Progetto in the returns form. The costs for the return of products are regulated by article 6.2.
Returned products shall be sent to Il Progetto in a single shipment. Il Progetto therefore reserves the right not to accept Products that are part of the same order that are returned at different times. Products shall be returned using the same packaging of delivery.

6.1. If the product has been returned in line with the terms and conditions set out in the above article 5, and the Products have been checked and passed, Il Progetto will send confirmation of acceptance of the returned Products via email.

6.2. As a result of the above, Il Progetto will refund the amount paid by the Client, net of any discounts and/or promotional offers.
The cost of returning Products to Il Progetto are to be paid by the Client as follows:
a) If the Client decides to use a courier of choice, then he or she shall pay this courier the shipping costs, which will be the sole costs to be borne by the Client for the return of items.
b) If the Client decides to use the courier indicated by Il Progetto in the return form, then he or she will not have to pay for the shipping costs for the return of purchased Products in person. Payment for shipping costs to return Products will be made for the Client, directly by Il Progetto, which will exonerate the Client from all obligations to pay the courier. Il Progetto, when refunding products, will retain a lump-sum payment to cover previous shipping and costs for the delivery of the purchased Products to the Client. From the moment that the purchased Products are returned to the courier indicated by Il Progetto in the returns Form, the Client is free from all liability in case of loss or damage to the Products during transport.
Whatever method of payment used by the Client, Il Progetto will make refund payments within the least possible amount of time and in any case, within thirty (30) days of the date on which Il Progetto was notified of the Client’s intention to return the items, subsequent to compliance with all of the requirements necessary to exercise the right to return.
The refund will be made using the same payment method as used for the online purchase.

6.3. If there is no correspondence between the recipient of the Products listed in the order form and the person making payment of the sums owed for the purchase of same, the refund will be made by Il Progetto and in any case, to the person making payment.

6.4. The procedures above are valid also for products replacement. So the customer who wishes to replace a product with another favorite, will have to follow the procedure for cases of withdrawal (as described in article 5.1; 5.2; 5.3; 5.4 & 6.1; 6.2; 6.3); after that, the customer will purchase a new product, according to the availability of the SHOP on LINE of the site

7.1. The Products illustrated on the Web site are Il Progetto brand products. The features of each Product will be listed on the Web site, in the individual product info; however, colours may not correspond to those of the items themselves, due to the effect of browser settings or of the monitor used.

7.2 If the Client considers the Products purchased to be faulty, he/she can return them:
a) implementing a returns procedure, within 14 days from the date of receipt of the Products in question;
b) sending them to the Il Progetto address, as described in article 5.3.

7.3 Il Progetto will carefully examine the returned Product (which shall have the relevant composition, brand and care labels attached) and will communicate confirmation and acceptance of the returned Product. In the event the faulty Products are accepted, Il Progetto will refund the relevant amount to the Client.

9.1. . The General Conditions of Sale are based on Italian law and specifically by legislative decree no. 206 of 6 September 2005 (Consumer Code) with specific reference to the regulation of distance contracts and legislative decree no. 70 of 9 April 2003, regarding some aspects concerning e-commerce.
For any dispute concerning the validity, interpretation, or execution of the General Conditions of Sale, the court of jurisdiction will be the area in which the consumer is resident or domiciled.
